1. Our Relationship & Scope of Services

  • What you can expect from us: CyberNet XLabs provides defensive cybersecurity solutions, digital forensics, data recovery, and IT infrastructure protection. We act as technical and security consultants.

  • Ethical Operations Only: We strictly provide White-Hat (Ethical) Security Services. We do not engage in illegal hacking, unauthorized access, or cyber-attacks against any individual, organization, or government entity.

2. What We Expect from You (User Responsibilities)

To use our services, you must follow these rules (Inspired by Global Standards):

  • Accurate Information: You must provide complete and accurate information when seeking consultation, especially for cyber fraud cases or hacked account recoveries.

  • Lawful Use: You agree NOT to use our tools, scripts, or consultation for any malicious or illegal activities. If a user asks us to illegally hack an account or network, we reserve the right to deny service and report the user to appropriate authorities.

  • Authorization: For B2B Vulnerability Assessments (Penetration Testing) or Data Recovery, you must be the legal owner or an authorized representative of the network, device, or business data being tested/recovered.

3. Service-Specific Terms & Limitations

  • Hacked Account Recovery: We act solely as technical consultants to help you navigate the recovery processes of third-party platforms (like Facebook, Google, Instagram, etc.). We do not own these platforms, and the final decision to restore an account rests entirely with the respective company. We do not guarantee 100% recovery of suspended or deleted accounts.

  • Cyber Fraud Consultation: Our guidance regarding OTP scams, UPI frauds, and fake loan apps is for educational and procedural purposes (e.g., helping you file a complaint on 1930). It does not constitute formal legal representation in a court of law.

  • Data Recovery & Malware Removal: While we use advanced digital forensic tools, the success of data recovery depends on hardware health and the type of encryption (in ransomware cases). We are not responsible for pre-existing physical damage to devices.

4. Intellectual Property (Your Content & Our Content)

  • Your Content: You retain all ownership rights to your personal or business data (Tally data, documents, CCTV footage). We only process it to fulfill the service.

  • Our Content & Software: All scripts, custom software codes, training materials, and website designs provided by CyberNet XLabs remain our intellectual property. You may not reverse-engineer, resell, or distribute our security tools without explicit written permission.

5. Warranties & Disclaimers (Google Standard Shield)

We provide our services using a commercially reasonable level of skill and care. However, there are certain things we don’t promise about our services:

  • "As Is" Basis: ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO SPECIFIC PROMISES ABOUT THE SERVICES.

  • No 100% Security Guarantee: Due to the constantly evolving nature of cyber threats (Zero-Day exploits, new malware variants), CyberNet XLabs does not warrant that your systems will be 100% immune to future cyber-attacks after our service is completed, especially if our security guidelines are bypassed by the user.

6. Limitation of Liability

To the maximum extent permitted by law, CyberNet XLabs, its founders, and employees will not be responsible for:

  • Loss of profits, revenues, business opportunities, or goodwill.

  • Indirect, special, consequential, exemplary, or punitive damages.

  • Data loss resulting from hardware failure during the recovery process or subsequent cyber-attacks due to client negligence (e.g., clicking on phishing links after security training).

7. Business Users and Indemnification

If you are using our services on behalf of a business (B2B Services like Network Security, VAPT, or BYOD Management):

  • That business accepts these terms.

  • The business will hold harmless and indemnify CyberNet XLabs from any claim, suit, or action arising from or related to the use of the services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys’ fees.

8. Suspension and Termination

We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users of our services, us, or third parties, or for any other reason.

9. Modifications to these Terms

We may update these terms to reflect changes in our services, how we do business, or legal requirements (such as updates to the IT Act). We will post the revised Terms on this page. Your continued use of our services after any changes means you accept the new Terms.

10. Governing Law and Jurisdiction
